I had been there all night. I couldn&#8217;t figure out how to get Rita my new number, and I didn&#8217;t know her attorney. In an Effexor-induced manic and increasingly panicked state, I thought if I sent Rita an innocuous text message, she would realize it was from me and have my number. Thus, I sent her a period (.). I figured the worst that could happen was getting arrested again and getting time added to my probation. I was hoping that Rita would not report it. \u00a0Again, I was incredibly naive.<\/p>\r\n<p>Not long later, still in my office, I started getting calls from &#8220;blocked&#8221; numbers and assumed it was the police. I again panicked and decided to return the phone later that morning, which was a dumb thing to do in hindsight. Completely exhausted and hoping the police wouldn&#8217;t be able to link the phone to me, I went to my apartment and finally crashed after being awake for about 48 straight hours. I was awoken later that day by the police knocking at the door. \u00a0Completely disoriented, I gave them the new phone. They looked for the message but didn&#8217;t find it. They asked me if I deleted it, and I told them I had not. When they asked if I had sent the message, I told them I had, but I returned the phone and got the one they had now. They arrested me, handcuffed me, and took me back to jail. However, I suppose I&#8217;d changed my mind, and I thought this was better than going through being arrested again. Again, this period&#8217;s memories are blurry from stress, Effexor-induced mania, sleep deprivation, and turmoil. Not knowing how to contact a bail bond agent from jail or anyone else, I was processed and became an inmate at the Centre County Correctional Facility (CCCF) for the first time. The image gallery shows the commitment order issued by a district magistrate.<\/p>\r\n<p>The court hears PFA violation cases every two weeks, so I believe I spent about a week in jail before my hearing. I had never interacted with other inmates, and at first, it was a little intimidating. However, I quickly realized the worst part about being in county jail is the boredom, not the other inmates.<\/p>\r\n<p>I am taken, handcuffed, and shackled to the courthouse for my hearing again in front of Judge Ruest. My attorney was still on vacation, so her partner scrambled to fill in again. At this hearing is when I started to understand the protection from abuse system in Pennsylvania. The district attorney argued the case for the plaintiff\/state like in a criminal trial. I think this was also the first time I encountered the district attorney, Stacy Parks Miller. She will come up a lot throughout the rest of this book.<\/p>\r\n<p>Stacy argued that I&#8217;m some maniac that a psychiatric hospital had just released, that I&#8217;m dangerous, and there&#8217;s no telling what I&#8217;ll do next. This fear-of-the-future argument will come up again and again in hearings, i.e., &#8220;There&#8217;s no telling what he might do next.&#8221; There is no way to predict what a person might do in the future, as even that person doesn&#8217;t know. All I can say is that I&#8217;ve never done anything violent and have no plans to do so. Unfortunately, my attorney, who didn&#8217;t know me, could not counter the DA&#8217;s claims.\u00a0 I talk much about the &#8216;preventative&#8217; culture that society has developed in the book.<\/p>\r\n<p>The other argument I heard from the DA for the first of many times is that I should be convicted, not because I did anything violent or abusive, but because in violating the order, I disrespected the court&#8217;s authority, i.e., the contempt of court angle. At that point, I did not have a great deal of contempt for the court in Centre County.\u00a0 Although, I thought there was no reason for them to have put an order in place, and the court had not given me much opportunity to defend myself.<\/p><p><!--nextpage--><\/p><audio class=\"wp-audio-shortcode\" id=\"audio-138-3\" preload=\"none\" style=\"width: 100%;\" controls=\"controls\"><source type=\"audio\/mpeg\" src=\"https:\/\/unstablefocus.mynetgear.com\/wp-content\/uploads\/2026\/08\/Chapter-138-P03.mp3?_=3\" \/><a href=\"https:\/\/unstablefocus.mynetgear.com\/wp-content\/uploads\/2026\/08\/Chapter-138-P03.mp3\">https:\/\/unstablefocus.mynetgear.com\/wp-content\/uploads\/2026\/08\/Chapter-138-P03.mp3<\/a><\/audio><p>At the end of a whirlwind hearing that took probably 10 minutes, my head was spinning. The judge convicted me, and I recall the DA asking the judge to sentence me to two months in jail. My attorney requested the court to send me back to the mental health unit to adjust my medication.\u00a0 Going back to the hospital was not needed at that point as I realized that Effexor was the problem. I only continued to take it because I didn&#8217;t have any Zoloft. At this point in the hearing, I realized I was in trouble. My attorney had no idea what was going on, and I was not given a chance or prepared to defend myself at the hearing. Ultimately, Judge Ruest sentenced me to 30 days in jail, but I was released after 21 days because she learned Penn State had put me on unpaid leave.<\/p>\r\n<p>At this second hearing, I learned how much of a free-for-all indirect criminal contempt hearings are. I was dumbfounded at the time and couldn&#8217;t believe how easy it was for new allegations to materialize and how hard it is to try to counter them.\u00a0 There seemed to be no burden of proof for the prosecution, and the lawyers could make unsubstantiated allegations at will. Stacy and Tonia were both great at this. They would make so many ridiculous claims that there was no way the judge would be patient enough for my attorney to refute them. And because my attorney had no idea what Stacy or Tonia might say, they also could not be prepared to dispute them, and in fact, didn&#8217;t know if they were true. It&#8217;s just not feasible during a hearing to take the time to explain something to your attorney and then have the attorney explain it to the court. That is why there is a discovery process in criminal cases. In the end, I learned that the attorney that can lie and twist the truth the best will win.
